Module 5 · Common law of contract; Immigration Act (work permits)

Contracts & Hiring

Required contract elements, types of employment, probation and work permits.

Every written contract should state

  • Names of the parties and start date
  • Job title and main duties
  • Place of work and hours
  • Pay, pay frequency and deductions
  • Leave entitlements
  • Probation period and terms
  • Notice and termination terms
  • Reference to policies (discipline, grievance, confidentiality)

Probation lets both sides assess fit, but fair treatment still applies. Give feedback during probation and confirm the outcome in writing.

Non-nationals generally need a work permit from the Ministry of Homeland Security before starting work, unless an exemption such as a CSME Skills Certificate applies.

Record this risk in the Employer Self-Assessment
